Welcome to YES Containers. These Terms & Conditions ("Terms") govern your use of our website www.yescontainers.com (the "Website") and the services and products we offer ("Services"). By accessing or using the Website and Services, you agree to these Terms. If you do not agree, please refrain from using our Website and Services.

1. Company Information

YES Containers is a family-owned business with a nationwide presence. We specialize in selling and delivering high-quality new and used shipping containers across the continental United States and Canada. Our mission is to provide reliable storage solutions with a commitment to quality service and customer satisfaction.

3. Product Offerings

We offer a variety of shipping containers, including 20’ and 40’ units, available in both new and used conditions. All containers are inspected prior to delivery to ensure they meet the required quality standards.

  • Used Containers (WWT – Wind & Water Tight):
    Used containers are sold as WWT by default, meaning they are structurally sound and guaranteed to be wind and water tight. These units may show signs of prior use, including surface rust, dents, intense floor usage, patches, dings, and cosmetic wear. While fully functional, they are not refurbished.
    • Upgrade Option: If Cargo Worthy (CW) units are requested, an upgrade fee may apply. These containers are inspected at the depot and meet the structural standards required for international shipping, making them eligible for Cargo Worthy certification. However, unless specifically requested, no formal certification is issued. While they may have undergone minor functional repairs (such as patching or partial floor replacements), they are not refurbished or cosmetically restored. CW containers still show visible signs of use, such as scuffs, dents, normal floor usage, floor replacement, patches or surface rust. 
      In some cases, if WWT units are unavailable in a particular region, we may at our discretion automatically upgrade your order to a CW unit at no additional cost, in order to fulfill your delivery on time and maintain container standards.
  • New / One-Trip Containers:

    These containers have only been used once or twice for international shipping and are in excellent overall condition, with minimal cosmetic imperfections such as small dings or scuffs. New units are typically available in standard tan or beige, with slight variations in shade depending on the manufacturer.

    Requests for other colors — such as eg: charcoal gray, dark gray, light gray, green, black, yellow, pink or any other color than the ones considered standard — are considered specialty containers and come at an additional cost, as these colors are more expensive to produce and less commonly stocked. The final price adjustment depends on the market rate at the time of order, so we recommend confirming current availability and pricing with your YES Containers representative before placing your order.

    Special color orders also require advance notice and typically involve a lead time of 3–4 weeks or more ( sometimes less ), depending on production and depot inventory.

    • Color Disclaimer:
      Used containers come in a variety of colors from various shipping lines. We cannot guarantee a specific color on used units. If color is important, repainting is recommended or a new one-trip container can be requested if available.

Order Accuracy: The container type and configuration listed on the customer's invoice or order confirmation is the final and controlling record of what was ordered. This supersedes any prior verbal discussions, sales consultations, or website/marketing imagery, which are provided for illustrative and general reference purposes only. It is the customer's responsibility to review the invoice carefully before confirming their order

4. Payment Terms

4.1 Payment Details: Upon receipt of payment, your anticipated delivery date will be within 10-15 business days. Payment must be made in full before delivery is scheduled. Accepted payment methods include credit and debit cards, bank transfers, or other methods indicated during the checkout process.

4.2 Credit Card Verification: To prevent fraud, if the security system flags a transaction as suspicious, we may charge a small verification amount (between $0.01 and $5.00) to your card, which will be refunded upon confirmation, or released after 5 days if no confirmation received, the order will be canceled and the original transaction reversed.

4.3 Additional Charges

Charges arising after the original invoice — including failed delivery charges, holding and storage charges, detention, and damage charges under Section 5 — are invoiced separately and due upon receipt. Consistent with Section 4.1, delivery or redelivery will not be scheduled until all outstanding amounts on the customer's account are paid in full.

4.4 Late Payment

Any amount not paid when due bears interest at 1.5% per month, or the maximum rate permitted by applicable law if lower, accruing from the due date until paid in full. The customer is responsible for all reasonable costs of collection, including collection agency fees and attorneys' fees.

4.5 Invoice Disputes

Any dispute regarding an invoice must be raised in writing to info@yescontainers.com within ten (10) business days of the invoice date, specifying the disputed line items and the basis for the dispute. Invoices not disputed within that period are deemed accepted as accurate and payable in full. Where only part of an invoice is disputed, the undisputed portion remains due on the original terms.

4.6 Chargebacks and Payment Reversals

Initiating a chargeback, payment reversal, or bank dispute in respect of a charge properly incurred under these Terms constitutes a breach of this agreement. Where a chargeback is resolved in favor of YES Containers, or where the underlying charge is otherwise determined to have been properly incurred, the customer remains liable for the disputed amount together with any chargeback, representment, or processor fees assessed to YES Containers and the reasonable costs of responding to the dispute.

This Section does not limit the customer's right to raise a genuine dispute with YES Containers under Section 4.5, and customers are encouraged to contact us directly before initiating a payment dispute.

5. Delivery Terms

5.1 Delivery Scheduling: Please allow 4 to 5 business days after payment for us to schedule your delivery. Deliveries are made Monday through Friday and are subject to weather and logistical considerations. Prior to delivery, the customer will receive a Paid Order Confirmation matching the specifications on their invoice, along with a Delivery Checklist that must be completed and returned confirming container size, grade, door configuration, and any specialty features ordered. Delivery will not be scheduled until the completed checklist is received. Failure to identify a discrepancy on the checklist constitutes acceptance of the listed specifications, and any rejection at delivery based on a specification the customer confirmed will be treated per Section 5.3.

Delivery timeframes stated by YES Containers are good-faith estimates based on depot inventory and carrier availability. They are not guarantees. YES Containers is not liable for any loss, cost, or expense arising from delivery delay, including site preparation costs, equipment rental, labor standby, crane or forklift booking fees, or lost business.

5.2 Delivery Conditions: Customers must ensure a clear path for delivery, with at least 120 feet of straight space, 10-12 feet width and 14-16 ft height clearance, for unloading when purchasing a 40’ shipping container and at least 80 feet of straight space, 10-12 feet width and 14-16 ft height clearance for unloading when purchasing a 20’ shipping container. Delivery sites should be free from obstacles like mud, snow, trees, or power lines.

The customer is solely responsible for confirming that the delivery site meets these requirements before delivery is scheduled. YES Containers may request photographs of the delivery site, the approach route, and the intended placement area, and may decline to schedule delivery until they are provided. Confirmation of site readiness on the Delivery Checklist constitutes the customer's representation that the conditions in this section are satisfied. A delivery attempt that fails because these conditions were not met is a failed attempt under Section 5.3.

5.3 Failed Delivery: A delivery attempt is considered failed when the delivery cannot be completed due to site conditions, access limitations, customer unavailability, or any circumstance outside the control of YES Containers or the delivery company, additional delivery fees will apply. 

Examples include, but are not limited to:

narrow streets, wet, snowy, or muddy conditions, obstructed paths, steep grades, low bridges, vehicles blocking access, customer not present or similar obstacles like trees, mailboxes, or utility poles.

If a used container is rejected upon delivery due to cosmetic issues such as surface rust, dents, or patches, despite being inspected and classified as Wind and Water Tight (WWT), two delivery fees ( equal to the delivery fee represented on the invoice ) and a restocking fee ( in the amount of $250 ) will be charged. If the order is canceled, two delivery fees plus a cancellation fee of 15% of the invoice total (minimum $350), whichever is higher. If the customer chooses to upgrade to a One-Trip container, two delivery fees and the price difference will be charged.

The same fee structure above also applies when any container — new, one-trip, WWT, or CW — is rejected upon delivery for reasons other than a verified defect or discrepancy from the customer's invoice, including but not limited to a change of mind regarding container type, door configuration, size, or condition grade. The invoice is the controlling document for what was ordered; two delivery fees, plus a restocking fee, cancellation fee, or price difference (as applicable per the scenarios above), will apply."

When a delivery attempt fails, the initial delivery fee is non-refundable. The following additional charges then apply:

(a) Where the customer elects to reschedule delivery:

  • the charges invoiced to YES Containers by the delivery company for the failed attempt, passed through at cost;
  • any holding or storage charges under Section 5.5;
  • a redelivery fee equal to the original delivery fee, which YES Containers may reduce or waive in writing at its discretion.

(b) Where the order is cancelled following a failed attempt:

  • a return delivery fee equal to the original delivery fee;
  • a cancellation fee equal to the greater of 15% of the invoice total or $350;
  • any restocking fee or price difference applicable under the scenarios described above in this section.

(c) In either case: any towing, wrecker, recovery, standby, or detention charges invoiced by the delivery company.

The fees set out in this Section 5.3, in Section 5.5, and in Section 6.1 represent the parties' reasonable pre-estimate, made at the time of contracting, of the costs YES Containers incurs when a delivery attempt fails or an order is cancelled. Those costs include carrier and delivery company charges, depot and yard handling, inventory reallocation, scheduling capacity that cannot be resold, administrative processing, and payment processor fees. The parties agree these amounts constitute liquidated damages and not a penalty, and that actual damages in these circumstances are difficult to determine with precision at the time of contracting.

Please notify YES Containers in advance if you expect adverse weather conditions (e.g., muddy or soft ground) so that delivery can be rescheduled. If there isn’t enough space for delivery, the container will be unloaded as close as possible to the property, becoming the customer’s responsibility to move. If unloading is not possible, the container will be returned to the depot, and additional delivery fees and cancellation charges will apply.

Delivery companies allow a maximum of forty-five (45) minutes on site. Time beyond that is charged at $100 per hour, billed in hourly increments, payable directly to the delivery company or to YES Containers.

YES Containers uses third-party companies for delivery. These companies are insured, responsible for the delivery, and have their USDOT number on the truck.

5.4 Damages and extra charges: The customer is responsible for any damages or additional charges incurred by delivery trucks and/or trailers due to on-site conditions (e.g., trucks getting stuck, narrow streets preventing turns, a tree is too love and knocks over the container off the trailer and damages trailer and delivery truck , etc). Payment for such damages or charges must be made immediately, either directly to the delivery company or to YES Containers. If the customer refuses to pay, they authorize YES Containers to charge the additional fees to their credit card or bank account.

5.5 Container Holding and Storage: Where a delivery attempt fails and the customer elects to receive the container at a later date rather than cancel the order, YES Containers may, at its discretion and where the carrier or yard permits, arrange for the container to be held locally rather than returned to the origin depot.

Where a container is held, the following charges apply and are passed through to the customer at the rates charged to YES Containers:

(a) an in-gate fee per container; (b) an out-gate fee per container; (c) a daily storage fee per container, accruing from the date the container enters the holding yard until the date it departs for redelivery.

Applicable rates will be confirmed to the customer in writing at the time the holding arrangement is made. Holding charges accrue daily, including weekends and holidays, and are payable in full before redelivery is scheduled.

Containers may be held under this section for a maximum of fifteen (15) days. If the customer's site is not ready to receive delivery within that period, YES Containers may return the container to the origin depot, at which point return freight, a redelivery fee, and any applicable charges under Section 6.1 will apply.

During any holding period arranged at the customer's request, the container is in the custody of the third-party yard operator. YES Containers is not liable for loss, theft, vandalism, or damage occurring during the holding period.

6. Cancellation and Return Policy

6.1 Cancellation Policy

If you need to cancel your order, please do so within the delivery timeframe. All cancellations are subject to a 15% cancellation fee (minimum $350), whichever is higher, based on the total invoice amount. This fee covers administrative processing, vendor release procedures, allocation of inventory, coordination with depots and carriers, and associated operational costs incurred by YES Containers.

If the cancellation is submitted before the end of the same calendar day the order was placed, or in the event of a verified emergency, YES Containers may waive the cancellation fee at its sole discretion.

Credit/Debit Card Payments:
Payment processor fees (typically 3% ) are non-refundable to YES Containers. If a refund is issued, these processor fees will be deducted from the refund amount in addition to the cancellation fee.

Once the 24-hour processing period has passed, the order is considered confirmed for fulfillment, and the cancellation policy applies in full. If a customer agrees in writing to a paid modification of an existing order (such as an upgrade to a different container type), and subsequently withdraws that agreement, this cancellation policy applies in full to the modified order, in addition to any delivery or failed-delivery charges already incurred prior to the reversal.


6.2 30-Day Return Policy

Customers have a 30-day window from the delivery date to notify YES Containers in writing of their intent to return a container. After written notification is received, YES Containers will provide the designated depot address and approved return instructions. No return will be accepted without prior written authorization.

It is the customer’s sole responsibility to arrange and pay for all costs associated with returning the container, including but not limited to trucking, equipment rental, labor, and any logistical expenses. YES Containers does not reimburse any fuel, carrier, labor, or third-party transportation charges related to the return.

Returned containers must be in the same condition as delivered. Containers are subject to inspection upon arrival at the designated depot. Refunds will be issued only after inspection confirms the container remains in original delivered condition and is free of any new damage, deterioration, misuse, or alterations. Any deductions required to restore the unit to its original condition will be subtracted from the refund.

YES Containers does not apply a restocking fee. However, deductions for repair, cleaning, or handling may apply if discrepancies are found during inspection.

This return option is available only once per customer. Additional returns are not permitted.


6.3 Modification Clause

Any modification to the container voids the 30-day return right and all associated warranties. Modifications include, but are not limited to:

  • Cutting or altering walls, doors, floors, or roof

  • Welding, drilling, or structural changes

  • Installing windows, vents, or additional doors

  • Painting, grinding, sanding, or applying coatings

  • Adding insulation, framing, or interior/exterior build-outs

  • Any alteration that changes the container from its original delivered condition

Modified containers are not eligible for return, exchange, refund, or warranty claims under any circumstances.

All containers sold by YES Containers LLC are inspected and guaranteed to be dry boxes, except for AS-IS containers, which are sold in their current condition without any warranties (see Section 7.3).

Warranty Coverage:
We offer DrySeal and SteelStrong warranties only for Used Wind and Water Tight (WWT), Cargo Worthy (CW), and New One-Trip containers. AS-IS containers are excluded from any warranty coverage.

Used WWT / CW and New Containers: Inspected to ensure they meet industry standards for wind and water tightness but do not carry a standard warranty unless explicitly covered by our warranty program.
AS-IS Containers: Sold in as-is condition with no guarantees, warranties, returns, or rebates. These containers may have structural defects, rust, dents, holes, or other wear or damage that affects their usability. AS-IS units are not guaranteed to be wind and water tight or structurally sound. Buyers assume full responsibility for their purchase.

7.1 DrySeal 5-Year Leak Protection
Covers: Leaks due to normal wear and tear for all eligible containers purchased from YES Containers.
Resolution: If a leak occurs, we will provide a repair kit and instructions for sealing it.
Does NOT cover: AS-IS containers, cosmetic issues (rust, dents, previous patches), seals, gaskets, floors, modifications, relocations, or misuse.

7.2 SteelStrong 10-Year Structural Guarantee
Covers: The structural frame of eligible containers under normal storage use.
Does NOT cover: AS-IS containers, doors, seals, gaskets, floors, previous patches, cosmetic wear (rust, dents), modifications, relocations, or misuse.

7.3 AS-IS Shipping Containers – No Warranties, Final Sale
By purchasing an AS-IS shipping container from YES Containers LLC, the buyer acknowledges and agrees that the container is sold in its current condition, with no warranties or guarantees of any kind. AS-IS containers do not qualify for DrySeal or SteelStrong warranties.

All AS-IS sales are final. There are no returns, refunds, exchanges, or rebates under any circumstances. The buyer assumes all risks associated with purchasing an AS-IS container.

By completing a purchase from YES Containers LLC, the buyer acknowledges and accepts these warranty terms.

8. Limitation of Liability

YES Containers are not responsible for any damage to property ( examples: front or back lawn, ground, buildings, pipes, septic tanks, wires, fences, mailboxes, etc ) caused by the delivery process or the containers themselves. We are also not liable for any loss or damage to goods stored inside the containers.

All sales are final once the container has been delivered, and no refunds or exchanges will be provided beyond the return and warranty terms outlined above.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

10. Dispute Resolution

10.1 Informal Resolution. Before initiating any formal proceeding, the party raising a dispute shall give the other party written notice describing the dispute and the relief sought. The parties shall attempt in good faith to resolve the matter within thirty (30) days of that notice. This Section does not apply to an action by YES Containers to collect amounts invoiced and not disputed in accordance with Section 4.5.

10.2 Small Claims and Collection Actions. Either party may bring an individual claim in small claims court where the claim qualifies for and remains within that court's jurisdiction. In addition, either party may bring an action in a court of competent jurisdiction to recover amounts due under an invoice that has not been disputed in accordance with Section 4.5.

10.3 Arbitration. Any dispute not resolved under Section 10.1 and not within the scope of Section 10.2 shall be resolved by binding arbitration administered by the American Arbitration Association under its applicable Consumer or Commercial Arbitration Rules. The arbitration shall take place in Delaware or, at the customer's election, in the federal judicial district in which the customer resides. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

10.4 Individual Claims Only. All claims under these Terms must be brought in the party's individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

10.5 Costs and Fees. In any proceeding under this Section, the prevailing party is entitled to recover its reasonable attorneys' fees, filing fees, and costs of collection, to the extent permitted by applicable law.

10.6 Survival. This Section survives termination of the agreement and completion of any order.

11. Privacy Policy

Your use of our Website and Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

12. SMS/Text Messaging Terms

12.1 Opt-In Consent: By providing your mobile number and opting in, you consent to receive SMS messages from YES Containers related to your inquiries, orders, and promotional offers. Message frequency may vary based on your interactions with us.

12.2 Message Frequency: You may receive up to 5 messages per month. Message volume may vary based on your interactions and the services you have opted into.

12.3 Fees: Message and data rates may apply. Please check with your mobile provider for details on any charges.

12.4 Opt-Out Instructions: You can opt out of receiving SMS messages at any time by replying "STOP" to any message received. You may also opt out by contacting us directly at info@yescontainers.com or through our Contact page.

12.5 Help Instructions: For assistance, reply "HELP" to any of our messages or contact our customer support at 800-223-4755 or info@yescontainers.com.

12.6 Privacy: We respect your privacy and will handle your information in accordance with our Privacy Policy.

13. Intellectual Property

All content on our Website, including text, graphics, logos, and images, is the property of YES Containers or its content suppliers and is protected by copyright laws. Unauthorized use of any content is prohibited.

14. User-Generated Content

By submitting reviews, comments, or other content to our Website, you grant YES Containers a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, and display such content worldwide in any media.

15. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Website and Services after any changes indicates your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
